To finalize a real estate sale case, a notary generally has to perform several steps and tasks:

Step 1: Gather relevant information

The notary begins his work by gathering all relevant information;

The notary carries out extensive research to ensure the security of the transaction, including a good and valid title;

Step 3: Drawing up the deed of sale

The notary draws up the deed of sale, which is a document precising the rights and obligations of the parties to the deed;

Step 4: Strict control of funds for the vendor and purchaser

The notary ensures the availability and sufficiency of the necessary funds, which must be deposited in the notary’s trust account before the notarial deed is signed;

Step 5: Signing the deed of sale and other documents before the notary

The notary organizes a meeting, or two separate meetings, to read the deed of sale to the seller and buyer before signing before the notary, either in person or, in exceptional cases, remotely;

Step 6: Publication of the deed of sale

Before making disbursement, the notary must publish the deed of sale in the land registery without delay. He prepares certified copies of the deed for the parties.

Step 7: Release of existing mortgages, closing of transaction and conservation of transaction files

The notary is responsible for cancelling or discharging any mortgages granted by the previous owner (seller) to ensure the security of the real estate transaction.  Once the transaction has been closed, all relevant files must be kept for 10 years at the notary’s professional domicile.

The cancellation of charges and mortgages can sometimes take months to process, since the notary must obtain the full cooperation of the other parties involved, including the seller’s creditors.
